Welcome to Orvett Srl! These terms and conditions govern the sale of furniture, furnishings, and vintage/modern antiques (hereinafter "Products") through our website (www.orvett.com).
Please read all our online terms and conditions carefully, as they include important information regarding your legal rights and responsibilities.

1. ACCEPTANCE OF TERMS
Access to and use of our website, as well as the purchase of our products, are governed by these Terms and Conditions of Use. By placing an order on our website, you acknowledge that you have read, understood, and accepted the Terms and Conditions in their entirety, along with our Privacy Policy. If you do not agree to all or part of the Terms and Conditions, please do not use the website or proceed with any purchase.
We reserve the right to modify the Terms and Conditions at any time. It is your responsibility to periodically review this page for updates and/or changes. Your continued use of or access to the website following any changes will constitute acceptance of the changes.

2. ACCESS AND ACCOUNT
By accepting these Terms and Conditions, you represent that you are at least 18 years of age in the state or
province in which you reside, and that you have given us your consent to allow minors connected to you to use our site and related services on devices owned, purchased, and/or managed by you. To use our site, including accessing or browsing our online stores or purchasing products from us, you may be asked to provide certain information such as your email address, billing, payment, and shipping information. You may be asked to create a personal
account. In such a case, you agree to provide true, accurate, and complete information during registration. The use of false information or impersonation of others is prohibited. You are responsible for maintaining the security of your login credentials. Your account is personal and non-transferable. You are fully responsible for all activity that occurs under your account.
In the event of unauthorized use, you must promptly notify Orvett Srl.
Orvett Srl reserves the right to suspend or terminate an account at any time, without notice, if it believes these terms and conditions are infringed. have been violated.

3. OUR PRODUCTS
You acknowledge that the products for sale are used and dated.
The photographs and technical descriptions represent the current condition of the product. Any defects, signs of wear, patinas, or restorations are to be considered intrinsic characteristics of the product and not hidden defects. We have made every effort to provide an accurate presentation of our products in our online stores. However, the color and appearance of the products may vary depending on the type of device you use to access the store and the settings and configuration of that device. Therefore, we cannot guarantee that the appearance or quality of the products you purchase will fully meet your expectations or that they will match those described or displayed in the online stores.
All product descriptions are subject to change at any time, without notice and at our discretion. We reserve the right to discontinue any product at any time and to limit the quantities of products offered for any person, geographic area, or jurisdiction from time to time.

4. ORDERS
When you place an order An order constitutes an offer to purchase. Orvett reserves the right to accept or reject your order at its sole discretion for any reason. Your order is not confirmed until Orvett confirms acceptance. We must receive and process payment before accepting an order. Please review your order carefully before submitting it, as Orvett may not be able to honor requests to cancel an order after acceptance. If we reject, modify, or cancel an order, we will notify you by contacting you via the email, billing address, and/or phone number you provided when placing the order. Your purchases are subject to return or exchange only in accordance with our Refund Policy.

5. PRICES AND BILLING
Prices are quoted in euros.
Payments can be made using major credit and debit cards (Visa, Mastercard, American Express) and digital wallets such as Google Pay, as well as advance bank transfer and other local methods as available. Prices, discounts, and offers are subject to change without notice. The price charged for a product will be the actual price at the time the order is placed, and you will be able to view it in the order confirmation email. Unless otherwise specified, published prices do not include taxes, customs fees, or shipping, handling, or import charges. Prices published in our online stores may differ from prices offered in physical or online stores or in other stores operated by third parties. We may occasionally offer offers on Products that affect prices and are subject to terms and conditions that are independent of these Terms. In the event of a conflict between the terms of an offer and these Terms, the terms of the offer will prevail. For all purchases made in our stores, you agree to provide accurate, current, and complete purchase, payment, and account information. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You represent and warrant that (i) the credit card information you provide is true, accurate, and complete, (ii) you are authorized to use such credit card for purchases, (iii) charges incurred will be honored by your credit card company, and (v) you will pay the charges incurred according to the posted prices, including shipping and handling charges and all other charges, if applicable.

6. SHIPPING AND DELIVERY
Delicate products are packaged with special care (bubble wrap, pallets, etc.). Products are delivered to the address indicated by the customer. Shipments will be made after payment confirmation; for bank transfers, the credit to our account is valid; for credit card payments, the transaction confirmation from the credit card company is valid. Product shipping costs are indicated separately from the product price. The customer is always informed of the shipping costs before completing the purchase process and making payment.
The order will be fulfilled within the timeframe specified on the website. All deliveries are made by courier and generally take place within 14 business days after receipt of payment for deliveries in Italy. Standard delivery is to street level/curbside. The courier is not authorized to carry the product inside the home and/or delivery location. The delivery note issued by the carrier, dated and signed by the Customer upon delivery of the product, will constitute proof of transportation and delivery of the goods. You are responsible for inspecting the integrity of the package upon delivery. Any visible damage must be immediately noted on the courier's delivery note, signing "subject to inspection," specifying the reason (for example: "Subject to inspection due to damaged/open box"). Photographs of the damage must also be taken and sent to Orvett. We are not responsible for delays in shipping and delivery. All delivery times are estimates only and cannot be guaranteed. We are not responsible for delays caused by shipping couriers, customs procedures, or events beyond our control. Orvett Srl applies the Incoterms 2020 rules to define responsibilities, costs, and risks related to transportation.

The applicable rate depends on the type and choice made during the purchase process.

For End Consumers: Unless otherwise agreed, the sale is DPU
(Delivered at Place Unloaded) to the address provided by the customer. The seller
assumes the costs and risks of transportation to the destination, including unloading
of the goods. For shipments outside the EU, any duties, local taxes, or import customs
clearance charges are the sole responsibility of the customer.

For Companies and Professionals: During checkout, business customers can choose
between the following methods: a) EXW (Ex Works) Delivery. The goods are
made available to the customer at the Orvett Srl warehouse (located in Mussolente, Vicenza). The risk of loss or damage is transferred to the customer when the goods are made available to them. Loading and export procedures are the responsibility and expense of the customer. b) DPU (Delivered at Place Unloaded) Delivery. The seller
organizes transportation and unloading at the destination. Risk is transferred to the Customer upon unloading at the agreed-upon location. Import customs clearance procedures are the responsibility of the Customer. c) Non-EU Customer Obligations (EXW Delivery) In the case of EXW sales to non-EU countries, the Business Customer undertakes
to provide the Seller, within 90 days, with documentary proof of export
(e.g., exit MRN), under penalty of Italian VAT being charged where applicable.

7. RIGHT OF WITHDRAWAL AND RETURNS
In accordance with consumer protection regulations, you have the right to withdraw from the purchase contract without providing any reason within 14 days of receiving the product. The product must be in the same condition in which you received it and in its original packaging. Products damaged during the return process due to inadequate packaging will not be refunded. To initiate a return, contact us at shop@orvett.com. If your return is accepted, we will send you a return shipping label and instructions on how and where to ship the package. Items sent without a prior return request will not be accepted. Shipping costs are the customer's responsibility. As soon as we receive and inspect your return, we will notify you whether or not your refund has been approved. If approved, you will automatically receive a refund via your original payment method within 10 business days. It may take some time for your bank or credit card company to process and post your refund. Damage and Problems: Inspect your order upon receipt and contact us
immediately if there are any defects or damage, or if you received the wrong product. This
will allow us to evaluate the issue and resolve it.

Exceptions/Non-Returnable Items: Certain types of products cannot be
returned (for example: special orders, custom products, and/or personalized
orders). If you have any questions or concerns about a specific product, please don't hesitate to contact us. Unfortunately, we cannot accept returns on promotional items or gift cards.

Exchanges: The fastest way to ensure you get what you want is to return the product you received and, once accepted, purchase the new product separately.

8. INTELLECTUAL PROPERTY
All content on the site (site name), including brands, text, images, videos, audio, graphics, logos, and software, is the property of Orvett Srl, its affiliates, or licensors and is protected by copyright and intellectual property laws. Any unauthorized reproduction or use is prohibited.

9. PRIVACY POLICY
All personal data we collect through our site is subject to our
Privacy Policy, available here. By using our site, you confirm that you have read, understood, and accepted the aforementioned privacy policies.

10. LEGAL GUARANTEE OF CONFORMITY
The buyer declares having examined the condition of the product
through the images and detailed description provided in the product sheet,
accepting the characteristics related to the vintage nature of the product. The seller informs that the modern and vintage products purchased on the site are used. These products are guaranteed against defects in conformity (other than normal wear and tear and patina, expressly indicated in the descriptions and photographs) for a period of 12 months from the date of delivery, as is the case for used goods. Product conformity must be assessed considering the nature of the product as a second-hand item and the description provided.

11. LIMITATIONS OF LIABILITY
Our products are furniture, furnishings, and vintage/modern antiques. Any aesthetic imperfections, signs of wear, or minor defects do not constitute defects in conformity but are distinctive features. To the extent permitted by applicable law, we will not be liable for indirect or consequential losses, including loss of opportunity or profits, damages caused by force majeure, events beyond our control, or delivery delays attributable to exceptional circumstances. We are not liable for damage or loss resulting from improper or non-compliant use of the product with respect to its intended purpose and the instructions provided. It is the customer's responsibility to ensure that the product is used appropriately and treated with due care.

12. TERMINATION
If we terminate or suspend your account for any reason, you are prohibited from registering or creating a new account. We reserve the right, in our sole discretion and without notice or liability, to deny you access to and use of the site.
We reserve the right to take appropriate legal action, including, without limitation, civil, criminal, and injunctive relief.

13. SEVERABILITY
If any provision of these Terms and Conditions is held to be unlawful, void, or unenforceable, it shall be deemed unenforceable to the extent permitted by applicable law, and the unenforceable portion of these Terms and Conditions shall be deemed severable, which shall not affect the validity and enforceability of any remaining provisions.

14. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by Italian law. If the Customer is a Consumer, any disputes shall be subject to the exclusive jurisdiction of the Court of the Consumer's place of residence or domicile, if located within the Italian territory. For Consumers residing abroad, the provisions of European Regulations or International Conventions shall apply. If the Customer is a Professional/Company, any disputes relating to the interpretation or execution of the contract shall be subject to the exclusive jurisdiction of the Court of Vicenza.
